New Mexico Supreme Court Renders Decision in Arroyo Hondo Heliport Case

On October 1 the New Mexico Supreme Court denied Edmund Healy’s appeal of the Court of Appeals earlier decision in favor of the acequia parciantes of the Acequia Madre del Llano and remanded it back to the Court of Appeals. As reported in the July 27, 2021 La Jicarita,  the Appeals Court directed the Taos County Commission to rehear the parciantes complaint that Healy’s heliport in Arroyo Hondo “interfered with their access to and use of a lateral that runs across the Healy property to their fields.” The Appeals Court found that the county failed to meet the provisions of Taos County Ordinance 2015-02 Land Use Regulations that requires permission from the affected acequia’s commission for any construction activity that disturbs an acequia “in any way.” The parciantes hope that Taos County, with newly elected commissioners, will commit due diligence to this case that can potentially lead to the examination of other county land use regulations regarding the status of acequias.

 

Santa Fe County to sponsor Town Hall on Nuclear Waste Emergency Response

SANTA FE – Santa Fe County Commissioner Anna Hansen (D-2) is hosting a Nuclear Waste Emergency Response Town Hall meeting on Tuesday, October 19, 2021, at the Nancy Rodriguez Community Center, 1 Prairie Dog Loop, Santa Fe, NM 87507.

Cynthia Weehler will present highlights of the Department of Energy’s proposal to expand the Waste Isolation Pilot Plant (WIPP) repository and the transportation of plutonium throughout Santa Fe County and specifically along the NM 599 corridor.

Santa Fe County Fire Chief Jackie L. Lindsey will provide a special presentation on Santa Fe County’s emergency preparedness and response in the unlikely event of a toxic and radioactive waste incident.

New Mexico State Representative Tara Lujan (D-48) will also be in attendance. Attendees will have an opportunity to express concerns and ask questions during a 35-minute open discussion.
